CREC (Fingerprinting) Clarification

Subject: CREC Releases Clarification of Emergency Rule - from Colorado Association of REALTORS
On January 16, 2007, the Colorado Real Estate Commission (CREC) released a position statement to clarify the emergency rule A-15 adopted January 5, 2007 that accommodates numerous real estate brokers who have for reasons beyond their control have not met the required criminal background check requirements - (Fingerprinting) that was adopted August 2005.
One of the issues clarified pertains to the date of when a broker must have submitted their fingerprint requirements. According to the recently released CREC position statement "the renewal applicant can demonstrate and attest that he or she submitted fingerprints to the Colorado Bureau of Investigation (CBI) in accordance with CBI's policies and procedures on or before October 1, 2006.

The following are other factors the Commission will consider in determining not to place a renewal applicant's license on inactive status automatically:

• the renewal applicant can demonstrate that he or she has been informed by CBI that his or her fingerprints are UTC and he or she is in the process of complying with CBI's policies and procedures for conducting a criminal background check based upon a name search; or

• the Division of Real Estate has received notification directly from CBI that CBI has conducted a criminal background check of the renewal applicant using other means such as a name search and has forwarded that information to the Division of Real Estate.
